OVERVIEW
These Terms of Service (the “Terms”) govern your access to and use of all websites, mobile sites, applications and other services (collectively, the “Services”) operated by HODRGEAR, a Korean-registered company powered by Shopify. By visiting or using the Services, you accept these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
SECTION 1 – ACCESS AND ACCOUNT
You confirm that you are the age of majority in your jurisdiction (or have parental consent for minors). You agree to provide accurate information and to keep your account credentials secure.
SECTION 2 – OUR PRODUCTS
We try to display products accurately, but colours or appearance may vary by device. We may change or discontinue products, limit quantities or set geographic restrictions at our discretion.
SECTION 3 – ORDERS
Your order is an offer to purchase; it is accepted only when we confirm it and receive full payment. Orders may be rejected or cancelled for any reason. Returns and exchanges are handled under our Refund Policy. Purchases are for personal use only.
SECTION 4 – PRICES AND BILLING
Prices are shown in the checkout at the time of order and exclude taxes, duties and shipping unless stated otherwise. You warrant that the payment information you provide is correct and that you are authorised to use the chosen payment method.
SECTION 5 – SHIPPING AND DELIVERY
Delivery times are estimates. Title and risk transfer to you when we hand the goods to the carrier.
SECTION 6 – INTELLECTUAL PROPERTY
All content on the Services is owned by HODRGEAR or its licensors and protected by law. You may use the Services only for personal, non-commercial purposes and must not reproduce or exploit any content without prior written consent.
SECTION 7 – OPTIONAL TOOLS
Third-party tools are provided “as is” without warranties. Your use is at your own risk and subject to third-party terms.
SECTION 8 – THIRD-PARTY LINKS
Links to third-party sites are not under our control. We are not responsible for any third-party content or transactions.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Sales are made directly with HODRGEAR. Shopify is not responsible for any product, service, injury or loss arising from your transactions with us.
SECTION 10 – PRIVACY POLICY
Personal data is handled in accordance with our Privacy Policy and, where applicable, Shopify’s privacy practices.
SECTION 11 – FEEDBACK
By submitting feedback you grant us a perpetual, worldwide, royalty-free licence to use it for any purpose.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
We may correct errors or update information on the Services at any time without notice, including after you place an order.
SECTION 13 – PROHIBITED USES
You must not use the Services for unlawful, harmful or infringing activities. We may suspend or terminate your access for breach.
SECTION 14 – TERMINATION
We may terminate the Services or your account at any time without notice. Sections intended to survive termination will continue to apply.
SECTION 15 – DISCLAIMER OF WARRANTIES
Except as expressly stated, the Services and all products are provided “as is” and “as available” without warranties of any kind.
SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, HODRGEAR, Shopify and their affiliates will not be liable for any indirect, incidental, punitive or consequential damages.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless HODRGEAR, Shopify and their affiliates for any claims arising out of your breach of these Terms or your use of the Services.
SECTION 18 – SEVERABILITY
If any provision is found unenforceable, the remaining provisions will remain in effect.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Failure to enforce any right is not a waiver. These Terms constitute the entire agreement between you and us.
SECTION 20 – ASSIGNMENT
You may not assign your rights under these Terms without our prior written consent. We may assign our rights without notice.
SECTION 21 – GOVERNING LAW
These Terms are governed by the laws of the Republic of Korea. You and HODRGEAR submit to the exclusive jurisdiction of the Seoul Central District Court.
SECTION 22 – HEADINGS
Headings are for convenience only and do not affect interpretation.
SECTION 23 – CHANGES TO THE TERMS
We may update these Terms at any time by posting a new version on the website and, where legally required, providing notice. Continued use of the Services after changes are posted constitutes acceptance.
